Manage Waivers

The purpose of this code of conduct is to make sure all Elevation Athletics members’ parents know and understand what is expected of them, to help us all establish a consistent expectation for the parent’s behavior and how we expect our program to operate. By signing this code of conduct, I agree that I will abide by the following statements during my time as a member of Elevation Athletics: ● I will set the right example for my children and the other children on EA by showing sportsmanship, respect, and common courtesy always for EA members, EA coaches, competitors, officials, parents of other teams and all facilities. ● I will make sure my child knows I love them regardless of how fast they swim or how well I think they should be doing. ● I will always make sure my athlete has a ride to and from practices and competitions. ● I will appropriately volunteer my time to help the EA program and appropriately support the EA athletes and coaches at practices and competitions. ● I will NOT coach my child from the stands or pool deck at any meet or practice. ● I will NOT criticize my child or any other child through name-calling, abusive language, gestures, mental games, or physical abuse at any time. ● I will NOT criticize an EA coach through name-calling, abusive language, gestures, mental games, or physical abuse at any time. ● I will respect the integrity of the officials. ● If I have concerns, I will direct them to the EA head coach Grant Holicky first. ● I will NOT cause drama or additional problems for my child, other families, or the EA program as a whole. I understand the above expectations and realize my failure to adhere to these items may result in suspension from the EA team for my child or other disciplinary or legal actions.

The purpose of this code of conduct is to make sure all Elevation Athletics athlete members know and understand what is expected of them to help us all establish a consistent expectation for the athlete’s behavior and how we expect our program to operate. By signing this code of conduct, I agree that I will abide by the following statements during my time as a member of Elevation Athletics: ● I will respect and show courtesy to my teammates, coaches, and parents always. ● I will demonstrate great sportsmanship and respect at all practices and competitions. ● I will set a great example of personal behavior for my teammates to emulate. ● I will be respectful of my teammates mentally, emotionally, physically and with their personal property and space. ● I will NOT exhibit racist, sexist, homophobic, or otherwise inappropriate behavior toward my teammates or coaches, or to other teams’ athletes or coaches. ● I will attend all team meetings, practices, training sessions, clinics, and special events, unless otherwise excused by an EA coach. ● I will show respect for all facilities, property and transportation used by EA for practices, competitions, or team travel. ● I will refrain from foul language, violence, dishonest behavior, offensive or illegal actions. ● If I disagree with an official’s call, I will talk with an EA Coach and be respectful to the official. ● I will follow and obey all of USA Swimming’s rules and codes of conduct. ● I will do my absolute best to live a lifestyle conducive to my performing at my best. ● I will do my absolute best to learn as much as I can from the information provided to me by the EA coaches. ● I will give my maximum effort any given day toward my mental, physical, and nutritional actions, so I can become better today than I was yesterday. I understand that if I violate this code of conduct, I will be subject to disciplinary actions determined by the EA coaches and described in the EA Member’s Handbook.

I certify that I am the adult and/or parent or legal guardian for my child(ren). I hereby give my permission for any supervisor, coach or other team administrator associated with Elevation Athletics (EA) to seek and give appropriate medical attention for our child(ren) in the event of accident, injury, illness. I will be responsible for any and all costs associated with any necessary medical attention and/or treatment. I hereby waive, release and forever discharge Elevation Athletics (EA) from all rights and claims for damages, injury, loss to person or property which may be sustained or occur during participation in activities, whether or not damages or loss is due to negligence. I hereby acknowledge that myself, spouse or significant other, and children is (are) physically fit and capable of participation in activities.

In consideration for engaging in performance activities, whether standard or special event activities, at Elevation Athletics (EA); I understand fully that I will be voluntarily engaging in physical activities (which include but are not limited to swimming, aquatics, use of exercise equipment, group fitness, camps and clinics) that could involve serious risk of severe injury, physical bodily harm, drowning or other possible loss of life, which might result from either my own actions, or the actions or inactions or negligence of others. I understand the rules of play and/or conditions of the premises or any equipment, as well as the safe and proper use of facility and equipment at Elevation Athletics (EA). I am physically sound and suffering from no condition, impairment, disease, infirmity or other illness that would prevent my participation or use of such equipment or machinery. I further acknowledge that there may be other risks not known to me or reasonably foreseeable at this time. I assume all the foregoing risks and accept personal liability for the damages following such injury, caused or alleged to be caused, in whole or in part from the activity. I further release, waive, discharge, hold harmless and Indemnify Elevation Athletics (EA) and its officers, owners, subsidiaries, property manager, employees and agents, ("Releasees") from all demands, losses or damages on account of injuries caused or alleged to be caused, in whole or in part, by the negligence of any or all Releasees or otherwise. I assume full responsibility for any loss or property damage, that may be sustained by me, or loss or damage to property owned by me, while doing business with Elevation Athletics (EA). I have read the above waiver / release,and understand that I have given up substantial rights by signing it and sign it voluntarily. This agreement is legally binding upon participant, their heirs, estate and assigns. If person participating in activities is under 18 years of age, document must be signed and agreed by parent or guardian.

Unless otherwise agreed to, Elevation Athletics (EA) does not provide refunds. EA can cancel your membership AFTER you submit a cancelation form or email to info@elevationswim.com at least 30-days prior to withdrawal. EA requires 30-days notification prior to withdrawal for all membership groups.

I hereby give permission to Elevation Athletics to use my image and photographic likeness in all forms and media for advertising, trade and any other lawful purposes. This includes any and all images, photographs, and videos taken of me, without further compensation to me. All film or digital files shall constitute the sole property of Elevation Athletics. Otherwise, if a photograph subject or his or her parent or guardian no longer wishes to have their likeness used; written notice of opt-out must be made to Elevation Athletics including name and date. I am the parent or legal guardian of the minor named above and I affirm that have the legal authority to execute the above release. I represent that I am at least 18 years of age, have read and understand the foregoing statement, and am competent to execute this agreementon behalf of my child(ren). If a photograph subject or his or her parent or guardian no longer wishes to have their likeness used; written notice of opt-out must be made to Elevation Athletics including name and date via email to info@elevationswim.com.

Once enrolled in a membership group, a member's spot will be guaranteed for the season, year, month or session (depending on which training group the member signed up for) until a withdrawal notice is given, which requires 30-days' notice prior to withdrawal. This includes all training groups and sports at Elevation Athletics. All members registered in a current season, year, month or session must withdraw using the online withdrawal form or email to info@elevationswim.com 30-days prior to the end of the season, year, 3-month segment or month. If Elevation Athletics is not notified 30-days prior through the withdrawal form, the client will be automatically enrolled next month, 3-month segment, season or year, and your account will be charged on a monthly or yearly basis, based on the billing of the chosen membership group you have chosen. Billing will take place on the 1st of the month for the next month's membership fees. For instance, if you are signed up for June you will be billed on June 1.
